In a classic example of 'Government by Judiciary' U.S. District Judge Mariana R. Pfaelzer struck down portions of Proposition 187 as unconstitutional. It goes without saying that the ACLU supported Judge Pfalezer's decision. "Can a state set up its own immigration program? The answer is a resounding no."
